Session Overview

Parallel Proceedings in Motion: Tactical Strategies for Managing Concurrent ITC, PTAB, and District Court Actions

With patent disputes increasingly fought on multiple fronts, effective coordination across the ITC, PTAB, and district courts has become essential. Each forum has its own pace, procedures, and strategic implications—and missteps in one venue can have consequences in another. This session explores how to successfully manage concurrent proceedings and minimize cross-forum friction.

  • Coordinating strategies when litigating simultaneously before the ITC, PTAB, and district courts

  • How PTAB institution trends, Fintiv considerations, and discretionary denials are reshaping multi-forum planning

  • Managing stays, timing conflicts, and procedural collisions across venues

  • Aligning claim construction, invalidity positions, and expert testimony to avoid cross-forum inconsistencies

  • The impact of ITC outcomes on district court litigation and PTAB proceedings—and vice versa

  • Settlement and licensing dynamics when three venues are in play

  • Practical guidance for in-house counsel overseeing complex, multi-front enforcement or defense campaigns
