Navid Bayar is a trial lawyer in Reichman Jorgensen Lehman & Feldberg’s Silicon Valley office. His practice focuses on representing both plaintiffs and defendants in commercial and patent litigation in courts throughout the country.  He has experience with all aspects of litigation including examining witnesses before juries, taking and defending depositions throughout the country, and successfully drafting and arguing motions in state and federal court.

As a former Silicon Valley deal lawyer, he knows what drives (and resolves) high-stakes commercial disputes. From the outset of every engagement, his focus is on achieving the best results for his clients by identifying areas of leverage and developing a strategy to achieve his clients’ business goals. 

He makes it a priority to stay apprised of the law’s development and has handled disputes involving complex patented technologies, financial institutions, insurance agreements, start-ups, joint ventures, and cryptocurrencies.

Before joining the firm, Navid clerked for two federal judges, first for the former Chief Judge of the U.S. District Court for the District of Oregon, and later for a judge on the U.S. Court of Appeals for the Tenth Circuit. He started his career as a transactional attorney at one of the Bay Area’s premier law firms representing technology companies and venture capital funds in IPOs, M&A transactions, and private securities offerings, among other complex transactions.

Navid strives to maintain an active pro bono practice and is a former pro bono attorney with the Federal Defenders.

  • Currently representing CardWare in bet-the-company patent litigation against Samsung (E.D. Tex. Case No. 2:21-cv-0041).

  • Currently representing Kove IO, Inc. in a high-stakes patent case against AWS involving hyper-scalability of cloud storage (N.D. Ill. Case No. 1:18-cv-08175).

  • Currently representing VideoLabs in bet-the-company patent litigation regarding foundational video technologies against multiple companies, including Netflix, Facebook, Apple, and Starz.

  • Currently representing Dawgs USA in a Lanham Act false advertising appeal before the Federal Circuit (Case No. 22-2160).

  • Helped secure an $84 million willful patent infringement verdict on behalf of Cirba following a five-day jury trial (D. Del. Case No. 1:19-cv-00742).  After only two hours of deliberation, the jurors decided VMware willfully infringed Cirba’s patent covering virtualization technology.

  • Successfully represented private equity fund in confidential insurance coverage dispute and drafted summary judgment brief resulting in insurers’ duty to defend against class action alleging various theories of fraud.

  • Successfully represented software startup in breach of contract dispute with corporate customer resulting in a successful pre-litigation resolution.

  • Successfully represented a financial institution in confidential indemnification dispute with several loan originators for losses from suits over mortgage-backed securities offerings resulting in settlement.

  • Previously represented minority stockholders of blockchain technology startup in fiduciary duty and trade secret theft litigation against the startup’s controlling stockholder and certain directors.  Case is pending in N.D. Cal.

  • Previously represented whistleblowers in False Claims Act case against national hospital chain for history of Medicare over-billing.  Case is pending and under seal.

  • Counseled dozens of technology companies on capitalization, corporate governance, and intellectual property matters in prior life as Silicon Valley corporate attorney.
